Oregon Tribe Has Hunting and Fishing Rights Restored Under a Long-Sought Court Ruling

The tribe was among the dozens that lost federal recognition in the 1950s and ‘60s under a policy of assimilation known as “termination.” Congress voted to re-recognize the tribe in 1977. But to have their land restored, the tribe had to agree to a federal court order that limited their hunting, fishing and gathering rights.

Rakeisha Burns, 18, (top) and Selena Harris, 38, are the sister and mother of Andre Dupree Payton, whose 2010 murder remains unsolved.


The sisters and mother of 19-year-old murder victim Andre Dupree Payton were arrested Jan. 12, in connection with a Dec. 26 assault on a Portland MAX train. Rakeshia Shamone Burns, 18, her 16-year-old half-sister, and that girl's 13-year-old sister have been charged with assault in the third degree, riot, disorderly conduct, harassment, and interfering with public transportation.

Selena Estelle Harris, 38, Payton's mother and the mother of Burns and her 16-year-old half-sister, was also arrested for two counts of hindering prosecution. Harris is accused of lying to police officers about her daughters location and hiding them from police.

Karley Buckland, 14, a Centennial Middle School student, was assaulted by three girls as she rode the Green Line MAX train. Buckland and her family say she did not know the girls. A poor- quality video, briefly posted on You Tube and now posted at The Oregonian website, shows three girls berating Buckland and raining blows on her, while other teens laugh and cheer. Buckland sustained some "bumps" to her head, according to the family. Other videos of the incident reportedly were confiscated by staff at Buckland's school.

Burns and Harris were booked into the Multnomah County Jail, while the two juvenile girls were sent to the Donald E. Long Juvenile Detention Home.

Burns spoke at her brother's funeral in October 2010. Payton was shot dead outside a downtown nightclub Sept. 19, 2010. His  murder remains unsolved.


Tina Duckett and Daughter Markishia Arrested For Bus Assault

Police arrested a mother and daughter suspected of an assault on a TriMet bus, Jan. 12. Tina Renee Duckett, 36, and her daughter Markishia Welikea Duckett, 19, were charged with interfering with public transportation, felony assault and misdemeanor assault. Tina Duckett was also charged with theft of services.
The assaults took place on a bus at Southeast 122nd Avenue and Division Street. The Ducketts boarded the bus and allegedly attempted to ride with invalid transfers. Police say, the bus driver drove to the next stop and told the girls they needed to leave the bus at which point the girls became verbally abusive to the driver.
When Michael Cooke, 23, asked the girls to leave the bus so it could get moving, Markishia Duckett allegedly punched him in the face.
Natasha Van Warmer, 23, traveling with a small child, asked the women to stop acting out in front of her child. The Ducketts then are alleged to have attacked her, with Tina Duckett grabbing her by the hair while Markishia punched her.
Both women were booked into the Multnomah County Jail.

Benson High School Student Assaulted Near Max Line
A Benson High School student was assaulted Wednesday evening, Jan. 11, crossing  Interstate Avenue on his way to the Yellow Line Max train. The teen had just left a wrestling tournament at the school and was on his way home.
While crossing North Interstate Avenue to get to the northbound Yellow Line, the driver of a silver Toyota Avalon yelled at the victim as he crossed the street. He was wearing ear buds, so he pulled them out and asked what was said. At that point, the driver of the Avalon got out and punched him in the head. When he stumbled and fell down on to the MAX tracks, the suspect kicked him in the head, then got back in the Avalon and drove away northbound on North Interstate Avenue.
The suspect is described as a black male in his 30s, 5'10" tall, 200 pounds, possibly wearing a black coat over a gray or silver hoodie or sweater.
Several witnesses have described the assault and the perpetrator.
The teen was transported to an area hospital with non-life-threatening injuries.
Transit Police Division officers will be reviewing surveillance video to further the investigation.
